Invito alla mediazione – Art.5, comma III, d.lgs. 4 marzo 2010 n. 28 - Condizioni, Conseguenze – Potere degli avvocati – Circondario del tribunale.
Il giudice può invitare le parti a valutare la possibilità di un tentativo stragiudiziale di mediazione, giusta l’art. 5,
comma III, d.lgs. 28/2010, là dove taluni elementi della causa siano indicativi di una buona probabilità di chances di conciliazione. Tanto avviene, in particolare, dove la causa interessi,
dal punto di vista soggettivo, due litiganti legati da un pregresso rapporto di origine familiare, destinato a proiettarsi nel tempo in modo durevole e, quindi, allorché meriti di essere
salvaguardata la possibilità di conservazione del vincolo affettivo in essere, posto che la mediazione, diversamente dalla statuizione giurisdizionale, può guardare anche all’interesse (pubblico)
alla “pace sociale”, favorendo il raggiungimento di una conciliazione che non distribuisce ragioni e torti ma crea nuove prospettive di legame destinate a far sorgere dal pregresso rapporto

La legge non ricollega alcuna conseguenza al rifiuto dell’invito del Giudice (coerentemente con l’istituto della Court Annexed Mediation, di fatto recepito nell’art. 5 comma III cit.) e
tale omissione non può essere colmata né con l’art. 116 comma II c.p.c., né con l’art. 88 c.p.c., in quanto il Legislatore ha voluto che la scelta dei litiganti fosse libera e genuina non
influenzata dal timore di ricadute sfavorevoli nella futura decisione giurisdizionale (è una mediazione su invito e non comando del giudice). Le parti devono quindi essere avvisate che del loro

La legge non specifica quale sia la parte che debba pronunciarsi sull’invito: se quella in senso sostanziale o il rappresentante legale. Deve, però, ritenersi che l’adesione all’invito
costituisca una estrinsecazione del potere di cui all’art. 84, comma I, c.p.c. e quindi l’avvocato possa pronunciarsi in merito all’adesione o non. Depone verso tale soluzione anche il dato
normativo che “contestualizza” invito e rinvio per l’adesione, non agevolmente immaginabile ove il Giudice dovesse, invece, rivolgere l’invito alla parte sostanziale, in genere assente dalle
udienze civili se non richiesta di comparire (v. artt. 117, 185 c.p.c., etc.) E’, però, ovvio, che, di fronte all’invito, pur se muniti di procura e pur se dotati del relativo potere, gli
avvocati abbiano diritto a conferire con il cliente per fare in modo che la loro decisione sia rispettosa dell’attuale desiderio/bisogno del loro assistito. Possono, cioè, ottenere un breve
